Freedom to Operate

Freedom to Operate

The freedom to make, use, import, or sell a product or process without infringing third-party patents.

The possession of a granted patent for your product or service does not itself provide freedom to operate.  It is possible, and common, for a product or process to be covered by many different patents (e.g. relating to different parts of the product or process or to distinct improvements).  Any such patent may therefore be used to prevent commercialisation of that product or process.

Searches (commonly referred to as FTO searches) can be performed to try to identify potentially problematic patents or patent applications and allow mitigating action to be taken to reduce risk.
